These Terms and Conditions (“Agreement”) apply to all residential services provided by Rescue Me Pool Services LLC (“Company”, we” or “us”) to the homeowner (“Client,” “you,” or “your”). By scheduling or authorizing services, you agree to these terms.

1. Services Provided

  • Pool cleaning, maintenance, and chemical balancing

  • Pool equipment inspection, troubleshooting, and repair

  • Pool start-ups, shutdowns, and filter service

  • Pool drains, acid washing, chlorine rinse, and surface cleaning

  • Backyard misting system installation, repair, and maintenance

  • Landscaping and hardscape installation or repair

  • Shade structures, patio shades, and privacy/shade window screens

  • Minor residential home repairs

Only services specifically listed in a written estimate, invoice, or service agreement are included.

2. Estimates &Changes

Estimates are based on visual inspections and information available at the time. Arizona properties may contain concealed or underground conditions (plumbing, groundwater pressure, electrical, irrigation, or utilities) not visible at the time of estimate. If additional work or materials are required, pricing may be adjusted. Client approval will be obtained when reasonably possible.


3. Payment Terms

Payment is due upon completion of service unless otherwise agreed in writing. Deposits may be required for draining, acid washing, installations, repairs, or special-order materials. Late or unpaid balances may result in service suspension and collection as permitted by Arizona law.

4. Access &Utilities

Client agrees to provide:

  • Safe and unobstructed access to the pool, equipment, and work areas

  • Working water and electrical connections

  • Removal or securing of pets

The Company is not responsible for delays or incomplete work due to lack of access or utilities.

5. Pool Draining &Acid Wash Disclaimer

Client acknowledges and agrees that:

  • Pool draining carries inherent risks, including but not limited to surface damage, plaster cracking, shell movement, floating, or groundwater-related issues.

  • Acid washing is an abrasive process that removes a layer of plaster and may shorten the lifespan of pool surfaces.

  • Acid washing may reveal or consider pre-existing stains, discoloration, mottling, cracks, etching, or delamination.

  • No guarantee is made that staining or discoloration will be fully removed.

  • The Company is not responsible for damage caused by pre-existing conditions, groundwater pressure, hydrostatic valve failure, or structural defects.

Client authorization constitutes acceptance of these risks.

6. Pool &Equipment Disclaimer

The Company is not responsible for failure of aging, corroded, sun-damaged, or previously repaired pool equipment, plumbing, or fittings. Chemical treatments may expose existing surface flaws, stains, or discoloration.

7. Landscaping, Hardscape &Exterior Work

Arizona weather, soil conditions, water quality, and extreme heat affect materials and plant life. Natural materials may vary in appearance and longevity. Plant survival is not guaranteed unless specifically stated in writing. Client is responsible for proper watering and maintenance after installation.

8. Permits, HOAs &Property Lines

Permits will be obtained where required unless otherwise stated in writing. Client is responsible for HOA approvals, easements, property lines, and setback disclosures. The Company is not responsible for violations resulting from undisclosed restrictions.

9. Warranty

Labor warranties, if offered, will be provided in writing and limited to workmanship. Manufacturer warranties apply to parts and equipment. Warranties do not cover misuse, neglect, acts of nature, or third-party work.

10. Safety &Liability

The Company is licensed, bonded, and insured in the State of Arizona. Pool, chemical, and construction services involve inherent risks. Client agrees to keep children, pets, and unauthorized persons away from work areas.

11. Limitation of Liability

To the fullest extent permitted by Arizona law:

  • The Company’s liability is limited to the amount paid for the service performed.

  • The Company is not responsible for incidental, indirect, or consequential damages.

  • The Company is not responsible for damage to undisclosed underground utilities, irrigation lines, or concealed conditions.

12. Scheduling, Weather & Cancellations

Services may be rescheduled due to extreme heat, monsoon conditions, safety concerns, or equipment failure. Short-notice cancellations may result in a fee. Ongoing service schedules may change due to holidays or weather.

13. Termination

Either party may terminate services with written notice. Client remains responsible for payment for completed work and materials ordered.

14. SMS/Text Messaging Terms

Description of SMS Use Cases: By providing your phone number and opting in, you consent to receive text messages from Rescue Me Pool Services LLC related to: appointment confirmations, reminders, and scheduling updates; service notifications and technician arrival alerts; billing and payment reminders; promotional offers and seasonal service information (if opted in); and follow-up communications regarding completed services.

Opt-Out Instructions: You may opt out of receiving text messages at any time by replying STOP to any message. After opting out, you will receive a single confirmation message. You may also opt out by contacting us directly at the phone number or email address listed below.

Message Frequency & Rates: Message frequency varies based on your service schedule and account activity. Message and data rates may apply. Check with your mobile carrier for details regarding your text and data plan.

Carrier Liability Disclaimer: Rescue Me Pool Services LLC and mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission from your network operator.

Age Restriction: You must be 18 years of age or older to use our SMS services. By opting in, you confirm that you are at least 18 years old.

Privacy: Your privacy is important to us. Please review our Privacy Policy at https://www.rescuemepools.com/privacy-policy for information on how we collect, use, and protect your personal information, including your phone number.

15. Governing Law

This Agreement shall be governed by the laws of the State of Arizona.

16. Entire Agreement

These Terms and Conditions, together with any written estimate or service agreement, constitute the entire agreement.

17. Acceptance

Authorization of service constitutes acknowledgment and acceptance of these Terms and Conditions, including consent to receive SMS/text messages as described in Section 14.
